Terms of Service

The terms on which TechPHA is provided, including what the software does and does not take responsibility for.

These terms govern your use of the TechPHA website and application, provided by Techcopter Ltd, a company registered in England and Wales under number 14423500, whose registered office is 2 Frederick Street, Kings Cross, London WC1X 0ND, United Kingdom. By creating an account or using the service you agree to them. If you are agreeing on behalf of an organisation, you confirm you have authority to bind it.

Professional responsibility and the limits of the software

This section matters more than any other in these terms, so it comes first.

TechPHA is a tool that assists a process hazard analysis. It is not a substitute for the judgement of a competent engineer, for a properly constituted HAZOP team, or for compliance with any standard, regulation or internal procedure that applies to your facility.

  • Output produced by the AI is a proposal. It may be incomplete, may misread a drawing, and may be wrong.
  • Confidence values are indicative guidance. They are not a warranty of correctness.
  • Responsibility for reviewing, correcting, approving and issuing a study rests entirely with you and the qualified people carrying it out.
  • You must not rely on TechPHA output as the sole basis for any safety decision, design change or regulatory submission.

Nothing in the service constitutes engineering advice or certification.

Accounts

You are responsible for the accuracy of your account information, for keeping credentials confidential, and for activity carried out under your account. Notify us promptly of any unauthorised access. Accounts are for named individuals and must not be shared.

Plans, free use and payment

The Basic plan allows one complete study at no cost and without a card, with report preview but not report export. Paid plans add multiple studies, report export in PDF, Word and Excel, study history, LOPA worksheets and check lists, and priority support.

Professional is US$59 per month or US$590 per year. Team is US$199 per month or US$1,990 per year. Enterprise is priced individually. All prices are in US dollars and exclude any sales tax or VAT that applies where you are; billing is handled by PayPal, which applies tax according to your location. Paid plans renew automatically at the end of each billing period until cancelled.

Paid plans may be cancelled at any time. Cancellation takes effect at the end of the current billing period.

Your content

You retain all rights in the drawings, documents and study records you upload or create. We claim no ownership of them.

You grant us a limited licence to host, process and transmit that content strictly as needed to operate the service for you — including sending document content to our AI model provider for analysis, as described in the Privacy Policy. This licence exists only to run the service and ends when the content is deleted.

You confirm you have the right to upload the content you provide, and that doing so does not breach any confidentiality obligation, export control or third-party right. Take care when uploading documents covered by a client confidentiality agreement.

Acceptable use

  • Do not attempt to gain unauthorised access to the service or another workspace.
  • Do not reverse engineer, resell or white-label the service without written agreement.
  • Do not upload malware, or content you have no right to process.
  • Do not use the service to build a competing product.
  • Do not interfere with the integrity or performance of the service.

Availability

We aim to keep the service available and reliable, but it is provided without any uptime commitment unless a separate written agreement says otherwise. Maintenance, updates and changes to functionality may occur.

No service level agreement is offered on any plan today, including Enterprise. If one is ever agreed, it will be a separate signed document and it will govern over this section for that customer.

Intellectual property

The service, including its software, interface and documentation, remains our property and that of our licensors. These terms grant you a right to use the service, not any ownership in it.

Disclaimers

To the fullest extent permitted by law, the service is provided “as is” and we disclaim all implied warranties, including fitness for a particular purpose, merchantability and non-infringement. We do not warrant that AI analysis will identify every hazard, deviation, cause, consequence or safeguard, or that its output will be free of error.

Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential loss, nor for loss of profit, revenue, data or goodwill, nor for any loss arising from reliance on AI output in breach of the responsibilities set out above.

[Insert the liability cap. The usual formulation is the fees paid in the preceding 12 months, but on a Basic plan those fees are zero, which is a cap a court may not respect for software used in process safety work. This clause needs a solicitor, not a template — it is the one place where getting it wrong is expensive in exactly the situation it exists for.]

Nothing here excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud.

Suspension and termination

You may stop using the service and close your account at any time. We may suspend or terminate access for material breach of these terms, for non-payment, or where required by law. On termination you may request export or deletion of your content, subject to the retention described in the Privacy Policy.

Changes to these terms

We may revise these terms and will update the date above. Where a change is material we will notify account holders. Continued use after a change takes effect constitutes acceptance.

Governing law

These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, without prejudice to any mandatory consumer protections available to you locally.
